Q: What is Elder Law, and how does an Elder Law attorney differ from other attorneys?
A: Elder law is the area of law that deals with the unique legal issues of those people that are elderly or the specific legal issues of aging. Just like most elderly have a specific Doctor for their unique needs, there are attorneys that cater to those specific legal needs of the elderly.
An elder law attorney will limit their practice typically to Estate Planning, Medicaid, Veteran’s Benefits, Guardianship and Probate. The American Bar Association has allowed attorneys to be Certified in Elder Law. That is done through the National Elder Law Foundation and is a rigorous process. Out of over 1 million attorneys in America, only 462 are certified as Elder Law Attorneys. There are only two in Arkansas, with Todd Whatley, being one of those.
